General Terms & Conditions (the “Terms and Conditions”) applicable to participants in the Lavazza Competition

A. The Lavazza Competition

The Lavazza Competition (the “Competition“) is a competition being organised by P. Cutajar & Co. Ltd., a company registered under the Laws of Malta bearing company registration number C293 and having its registered address at Capital Business Centre, Triq Taz-Zwejt, Industrial Estate, San Gwann, Malta (the “Organiser“) in which participants (as further specified under Section C below) may take part, subject to the acceptance of these Terms and Conditions, by purchasing any of the Lavazza® products specified under Section D below (the “Product“), uploading the relative receipt/s (the “Receipt/s“), and indicating the value of the purchased Product/s on https://www.winwithlavazza.mt/ (the “Website“).

B. Duration of Campaign

The Campaign shall commence on the twelvth (12th) of October of the year two thousand and twenty-two (2022) and shall end on the twenty-third (23rd) of December of the year two thousand and twenty-two (2022), both dates included (the “Campaign Period“).

C. Eligibility and Participation

  1. Participants shall include individuals over eighteen (18) years of age, provided that employees of the Organiser shall not be eligible to participate in the Campaign (the “Participants“).
  2. Participants may participate in the Campaign by purchasing the Product, which is available on the market during the Campaign, at leading supermarket and convenience stores as indicated in Annex A.

D. The Competition

  1. In order to participate in the Competition,  Participants must purchase any Product from the following list of Lavazza® products:

  2. Receipts of purchase of a Product must be uploaded on the Website together with information including, inter alia, Outlet/Shop name, Date of Purchase, Receipt Number, Total Value of the purchased Product/s and Participant details. All request information must be duly filled in on the Website, indicating the Participant’s name and surname, mobile number and email address. Said details shall only be used in order to contact the relative Participant to inform them of his/her win and shall be stored on a Jotform, and may be used for marketing purposes, if the Participant agrees to this. The Organiser will not share the data collected with any third party for any reason whatsoever.
  3. A random online draw will be held on Friday twenty-third (23rd) of December of the year two thousand and twenty-two (2022).
  4. Two (2) winners will be selected, each allowed to be accompanied by one (1) other person, meaning that there will be a total of four (4) persons benefitting from the Competition.
  5. Participants who participate in the Competition will be in the chance to win a trip for two (2) persons to Torino, Italy, including the opportunity to visit the ‘Lavazza Nuvola’ and watch a Serie A Juventus football match in two thousand and twenty-three (2023) (the “Prize”).
  6. The Prize will consist of the following:
    1. Flights to Torino, Italy for four (4)  people; sometime between first (1st) of January of the year two thousand and twenty-three (2023) and the thirty-first (31st) of May of the year two thousand and twenty-three (2023);
    2. Accommodation for two (2) nights for four (4) people on a Bed & Breakfast board basis;
    3. A ticket for four (4) people to watch a Juventus Serie A football match; and
    4. A tour of ‘Lavazza Nuvola’ for four (4) people.
  7. Any and all additional costs and/or expenses incurred over and above the costs covered by the Prize are to be at the sole and exclusive cost of the winning individual/s.

E. Modifications and Termination of the Campaign

  1. The Organiser reserves the right to shorten, extend, and/or suspend the Campaign Period or otherwise modify the Campaign Period at its discretion and at any time.
  2. The Organiser reserves the right to modify any of the Terms and Conditions set forth herein, at any time, with or without notice, even though these changes may affect a Participant’s ability to participate in the Campaign. Matters relating to the processing of personal data will not be changed by the Organiser.
  3. The Organiser reserves the right to terminate or temporarily suspend the Campaign at any time, for any reason, with or without notice, even though the termination may affect a Participant’s ability to participate in the Campaign.
  4. A Participant’s participation in the Campaign constitutes the Participant’s acceptance to these Terms and Conditions, as may be amended from time to time. Participants are responsible for keeping updated with any changes that the Organiser may effect to these Terms and Conditions. The most current version of the Terms and Conditions will be made available on http://www.winwithlavazza.mt and will supersede all previous versions of these Terms and Conditions.

F. General Terms and Conditions

  1. The Organiser shall disqualify any Participant if the Participant engages in any improper activity in connection with the Campaign, or acts in breach of  any of these Terms and Conditions or applicable law. Disqualification on these grounds may result in the inability of the Participant to participate in the draw of the Prize. In addition, the Organiser shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary at its sole discretion.
  2. The Prize shall be exclusively for the benefit of the individual identified on the application form on the Website and shall not be transferable (inter vivos or by operation of law in case of demise) to any third party by P. Cutajar & Co. Ltd, including any family members of the Prize winner.
  3. The Organiser is not responsible for any incorrect or inaccurate information supplied by the Participants while participating in the Campaign.
  4. All questions or disputes whatsoever which may arise in connection with the Campaign and/or these Terms and Conditions will be resolved by the Organiser at its sole discretion.

G. Limitation of Liability

  1. The Organiser and its respective related companies, parents, subsidiaries, affiliates, and respective agents and their agencies, suppliers and other companies involved in the development or execution of the Campaign or the production or distribution of Campaign materials shall not be held responsible or liable in the event of a printing error or irregular packaging.
  2. Subject to Clause G.6, and to the fullest extent permitted by law, the Organiser, its officers, directors, shareholders, representatives, employees, promotion agencies, agents, successors, assignees, and/or service providers, shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of the Campaign or in connection with the Prizes offered through the Campaign.
  3. The Organiser makes no representation or warranties of any kind regarding the nature or quality of any Prizes which are provided during the Campaign. The Organiser shall not be held responsible and to the fullest extent permitted by applicable law accepts no liability for any Prizes that are defective in any way or do not meet the Participant’s expectations or requirements.
  4. As a condition of participating in this Campaign, and notwithstanding any other provision of these Terms and Conditions, the Participant agrees that any and all claims in relation to the Campaign shall be limited to actual, direct out-of-the-pocket costs incurred by the Participant to participate in this Campaign, and shall in no event include attorneys’ fees and/or any other indirect costs.
  5. All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms and Conditions, or the rights and obligations of the Participant and the Organiser in connection with the Campaign, shall be governed by, and construed in accordance with, the Laws of Malta.
  6. These Terms and Conditions constitute the entire agreement between the Participant and the Organiser pertaining to the subject matter herein. No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.
  7. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.

H. Data Protection

  1. The Organiser is a Malta-domiciled organisation whose primary offices are in Malta. The Organiser does not engage in any automated decision-making.  Any data collected by the Organiser is stored securely. Technical and other measures are in place to prevent access to the personal data by unauthorized third parties.
  2. The Campaign is not available to minors. If the Organiser has reason to believe that it holds the personal data of minors, it will delete it immediately.
  3. At any point in time during the processing of personal data the Participant has the following rights:
  4. Right of access – to request a copy of the information that the Organiser holds about them.
  5. Right of rectification – to correct data that the Organiser holds about them if it’s inaccurate or incomplete.
  6. Right to be forgotten – in some situations, a Participant may ask the Organiser to delete certain data it holds about and the Participant.
  7. Right to restriction of processing – in some situations, a Participant may ask the Organiser to restrict the processing of his data.
  8. Right of portability – a Participant may ask the Organiser to transfer certain data it holds about the Participant to another organization.
  9. Right to object – a Participant may object to certain types of processing such as direct marketing.
  10. Right to object to automated processing, including profiling – a Participant also has the right to object to the legal effects of automated processing or profiling.
  11. Right to complain about how Personal Data is being processed by the Organiser – a Participant can lodge a complaint directly with the Office of the Information and Data Protection Commissioner (https://idpc.org.mt/) and with the Organiser [fzcutajar@pcutajar.com.mt].
  12. Right to withdraw – a Participant has the right to withdraw consent, where given, at any time.

The version of these Terms and Conditions is currently Version 3 and was last updated on the tenth (10th) of October of the year two thousand and twenty-two (2022).
